Let court decide on Sarawak petroleum authority, says Abang Johari

KUCHING: The question of who has regulatory authority over petroleum activities in Sarawak should be decided by the court, says Premier Datuk Patinggi Tan Sri Abang Johari Tun Openg.

He was commenting on Petroliam Nasional Bhd’s (PETRONAS) move to seek clarification from the Federal Court on the laws governing petroleum operations in the state.

“I have no comment. They want direction from the court, so let the court decide,” he said when met by reporters after delivering his New Year 2026 Address at Borneo Convention Centre Kuching (BCCK) today (Jan 13).

He added that the issue touched on the jurisdictions of both levels of government, making it appropriate for the judiciary to provide clarity.

“Because it involves both the federal government and the state government, let the court decide. Nothing to comment,” he said.

He added that it is normal practice for parties to turn to the court for guidance in such situations and said the move would not have any major immediate impact.

“Standard practice. Maybe they are asking for direction from the court. Either way, it does not give much effect. At the end of the day, you have to find a solution, and that is clarity,” he said.

Previously, PETRONAS had filed a motion at the Federal Court in Putrajaya to seek clarity on the applicable regulatory framework governing its operations in Sarawak, with the federal and Sarawak governments named as respondents.

The application seeks the Federal Court to determine the legal position applicable to PETRONAS’ operations in Sarawak, to ensure that the company continues to operate in full compliance with the applicable laws and sound governance practices.

PETRONAS said the court action is not intended to challenge Sarawak’s development aspirations or hinder the role of Petroleum Sarawak Berhad (Petros) in the state’s energy sector.
