BERSATU backs petition, calls it principled move to defend rights

KUCHING: Parti Pribumi Bersatu Malaysia (BERSATU) Sarawak has expressed support for the Sarawak Government’s decision to file a petition in the Federal Court for a ruling on the constitutional validity and applicability of petroleum-related federal laws to the state.

In a statement, BERSATU Sarawak described the move as a principled effort to defend rights enshrined under the Federal Constitution and the Malaysia Agreement 1963 (MA63), rather than an act of confrontation.

The party said the state’s rights over natural resources, including oil and gas within its territorial boundaries prior to the formation of Malaysia, are fundamental constitutional matters that must be respected.

“Any issue involving the sovereignty of the state’s constitutional rights must be addressed clearly and conclusively,” it said.

BERSATU Sarawak warned that prolonged legal uncertainty could create instability in governance, administration and investment, potentially affecting both the state and national economy.

It stressed that seeking legal clarification does not undermine the federal government or national institutions but instead strengthens Malaysia’s federal system by ensuring it remains balanced, fair and consistent with constitutional provisions.

“The Federal Court’s decision will have significant implications not only for Sarawak but also for the overall management of the country’s energy resources. The judicial process should be respected and not politicised,” it said. 

BERSATU Sarawak said greater legal clarity would help strengthen investor confidence in the oil and gas sector, ensure more transparent and competitive management of natural resource revenues, and reinforce Sarawak’s position within the Federation.

It added that a clear constitutional determination would also support more equitable and inclusive development for future generations.

The party called on all parties to view the issue from the broader perspective of national interest rather than short-term political considerations, emphasising that Sarawak is a founding partner of Malaysia whose constitutional rights must be respected.
