Man gets 14 months for stealing motorcycle rim, tyre

KUCHING: A 29-year-old man was sentenced to 14 months’ imprisonment by the Magistrates’ Court here today for stealing a motorcycle rim and tyre outside an accessory shop earlier this month.

Magistrate Ling Hui Chuan handed down the sentence to Rosli Jaka, after he pleaded guilty to a charge under Section 379A of the Penal Code.

The offence carries a jail term of between one and seven years, and is also punishable with a fine.

The jail term takes effect from today.

According to the charge, Rosli committed the offence at about 11.30pm on May 2 at an accessory shop near Jalan Mahkamah Lama, where he stole a component part of a motor vehicle, namely a tyre and rim from a Yamaha motorcycle belonging to a 24-year-old man.

Based on the facts of the case, the victim discovered the front tyre and rim of his motorcycle missing when he returned to retrieve the vehicle parked in front of the shop.

Police later arrested the accused on May 6 at around 1.15pm following an investigation by a team from the Criminal Investigation Department (CID), Kuching District Police Headquarters (IPD).

During interrogation, Rosli admitted to committing the theft for his own use.

Investigations also revealed that the motorcycle used by the accused during the incident matched the one captured in the CCTV footage.

Police seized several items during the arrest, including the motorcycle believed to have been used in the crime, a key, a helmet, clothing, a spanner, and a pair of slippers.

The prosecution was conducted by Deputy Public Prosecutor Ahmad Fauzulutfi Suriani.

Rosli was unrepresented.
