Man fined RM2,800 for damaging former wife’s rented house

KUCHING: A man was fined RM2,800, in default eight months’ imprisonment, by the Magistrates’ Court here today for damaging his former wife’s rented house.

Magistrate Ling Hui Chuan meted out the sentence on 42-year-old Kho Tiong Tze Abdullah after he admitted to the charge under Section 427 of the Penal Code, which provides for imprisonment of up to five years, a fine, or both.

According to the charge, Kho committed the offence at about 11:30 pm on May 9 at a rented house near Jalan Nanas, Taman Hong Kong here, where he broke the glass door and window panes belonging to the owner, causing losses estimated at under RM150.

Facts of the case revealed that the complainant, who is the accused’s ex-wife, lodged a police report following the incident.

Investigations found that Kho had gone to the house in an angry state and began smashing the glass door and windows after a verbal altercation with the complainant, who accused him of behaving irrationally.

The complainant was staying at the rented house with her three siblings at the time, and the incident was witnessed by her elder sister.

Police arrested Kho on May 11 at Jalan Wan Abdul Rahman, Simpang Tiga, following investigations into the case.

Further checks showed that the accused tested negative for drugs but had a prior record under Section 309 of the Penal Code.

Deputy Public Prosecutor, Ahmad Fauzulutfi Suriani, prosecuted the case. The accused was unrepresented.
