KUCHING: A 40-year-old man was sentenced to 11 months in prison by the Magistrates’ Court here on today (Sept 7) for failing to comply with a condition of his licence under the Prison Act 1995.
Roy Tarmimi Libar pleaded guilty to the charge before Magistrate Nursyaheeqa Nazwa Radzali.
The court ordered him to serve the 11-month jail term from the date of conviction, Sept 7.
Roy, who was unrepresented, was charged with committing the offence at a house near Lorong Merdeka 15, Kampung Tupong Tengah here at about 9pm on Sept 9, 2025.
According to the charge, he had failed to reside at the designated residence as required under the licence issued to him.
The offence was framed under Section 43(4) of the Prison Act 1995, which carries a fine of up to RM2,000, imprisonment for up to two years, or both upon conviction.
The court heard that Roy was serving his sentence under a licence-based release pursuant to Section 43 of the Act and was required to reside at the designated address in Kampung Tupong Tengah.
The offence came to light after an Order to Produce (OTP) issued by the Kuala Lumpur Court was received by the Kuching District Parole and Community Services Office.
A parole officer subsequently contacted Roy and visited the designated residence on Sept 9, 2025, but found that he was not residing there as required.
The matter was then reported to the police for investigation.
Deputy public prosecutor Muhammad Aidil Akmal Sharidan appeared for the prosecution.
