KUCHING: A 40-year-old man was sentenced to 11 months’ imprisonment by the Magistrates’ Court here on Monday (June 29) for throwing a glass mug at his father’s face this month.
Magistrate Ling Hui Chuan imposed the fine on Roy Tarmimi Libar after he pleaded guilty to the charge under Section 323 of the Penal Code, read together with Section 326A of the same Code, which provides for enhanced punishment as the victim was a family member.
The court ordered the prison sentence to run from the date of conviction (June 29).
The offence under Section 323 of the Penal Code, read together with Section 326A of the same Code, carries a maximum imprisonment of two years, or a fine of up to RM2,000, or both, upon conviction.
Section 326A doubles the maximum term of imprisonment when the offence is committed against a spouse, former spouse, child, incapacitated adult or other family member.
The accused was charged with voluntarily causing hurt to his 62-year-old biological father at their house in Jalan Tun Salahuddin at about 2.30pm on June 24.
According to the facts of the case, the victim lodged a police report after being struck in the face by a glass mug thrown by the accused during an argument.
Police arrested the accused later that night at about 11.20pm.
Investigations revealed that the dispute stemmed from the accused’s dissatisfaction after his father reprimanded him for bringing his girlfriend to the family home and asked the woman to leave the premises.
In a fit of anger, the accused threw a glass mug at his father, causing a soft tissue injury to the left side of the victim’s face.
A medical examination confirmed that the injury was consistent with the assault.
The prosecution was conducted by Inspector Nur Shafiqa Nyaie Ilin. Roy was unrepresented.
