KUCHING: An online clothing seller was on Monday jailed three days and fined RM2,500 for possessing an imitation pistol and abusing drugs.
Mohammad Afif, 22, pleaded guilty to two separate charges before two different magistrates.
On the first charge, he was convicted under Section 36(1) of the Arms Act 1960 for possessing an imitation firearm — a pistol — at the Jalan Keretapi intersection around 1pm on June 19.
Magistrate Ling Hui Chuan handed the three-day jail sentence, effective from June 23.
According to the case facts, at around 4.30pm on that day, police came across a Facebook post by a user under the name ‘Borneo’, which featured a nine-second video depicting Afif brandishing what appeared to be a pistol out of a moving Proton Persona vehicle window.
A police report was lodged, which led to his arrest at around 6.30pm that day at Taman Sukma, Jalan Sultan Tengah.
Investigations revealed that Afif had pointed the imitation weapon at another car in an attempt to scare the driver, allegedly out of anger over the vehicle tailgating him and refusing to give way.
The incident was recorded by a member of the public.
In a separate courtroom, Afif pleaded guilty to a drug charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15(1) of the same Act, for consuming amphetamine and methamphetamine.
The offence was committed while he was in custody at the Kuching Narcotics Criminal Investigation Division (NCID) office at around 3.50pm on May 18, 2021.
Magistrate Syarifah Fatimah Azura Wan Ali fined him RM2,500 in default three months’ imprisonment.
The court also ordered him placed under police supervision for two years upon settling the fine or serving his sentence.
The cases were prosecuted by ASP Arman Ibrahim and Insp Nur Shafiqa Nyaie Ilin.
