Man fined RM10,400 for drug possession, use

KUCHING: A 36-year-old man has been fined a total of RM10,400, in default 21 months’ imprisonment, by the Magistrate’s Court here today (May 4) for multiple drug-related offences, including possession and self-administration.

Magistrate Nursyaheeqa Nazwa Radzali meted out the sentence against Alvin Octavius Fang Chi Feng, who pleaded guilty in two separate proceedings.

For the first case, Fang was fined RM3,900 in default seven months’ imprisonment for possessing 3.15g of methamphetamine, and RM4,000 in default nine months’ imprisonment for possessing 1.49g of nimetazepam (Erimin-5) in the second case.

Both offences were committed at a residence along Stutong Road at about 5 pm on Dec 30, 2025, and charged under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 12(3) of the same Act.

The law provides for a fine of up to RM100,000, imprisonment of up to five years, or both upon conviction.

According to the facts of the case, a police task force from the Padawan district conducted a raid at the premises and identified themselves before inspecting the suspect.

The accused then voluntarily handed over a transparent plastic packet containing crystalline substances and a foil packet with several pills, both suspected to be drugs.

Subsequent laboratory analysis confirmed the substances to be methamphetamine.

In a separate case, Fang was fined RM2,500 or five months’ imprisonment in default after admitting to self-administering methamphetamine and 3,4-methylenedioxymethamphetamine (MDMA) without authorisation.

He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15(1) of the same Act.

If convicted, he shall be liable on conviction to a fine up to RM5000 or to imprisonment up to two years.

The court also ordered that he be placed under police supervision for a period of between two and three years upon completion of his sentence, in accordance with Section 38B of the Act.

Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly prosecuted the cases, while Fang was represented by a defence counsel.
